David Bailey was admitted in 1991. He is an accomplished commercial litigator and has, throughout the years, covered a wide range of practice areas such as professional negligence, insolvency, debt recovery, commercial agency and intellectual property. David is also an accredited CEDR Mediator.
He has however always focused on all aspects of "lender oriented" litigation including professional negligence against solicitors, surveyors and other advisors, and mortgage related litigation.
He joined a specialist professional negligence practice where he became a partner and set up and led a dedicated team, who handled mortgage possessions and unsecured loss recoveries.
David joined the firm in 1998 as a litigation partner and Head of Services to Lenders department and Litigation department. Those services include possession proceedings, sales of properties in possession, unsecured loss recovery, professional negligence, fraud, forfeiture of leases and LPA receiverships.
David has acquired an in depth understanding of the mortgage industry. This enables him to immediately grasp the specific needs of each client and therefore to adapt his advice and the services his department provides to reflect those exact needs.
He is also highly experienced in pursuing professional negligence and fraud claims. He has an impressive track record of optimising recoveries for clients, and his cases are regularly reported in the legal press.
David lectures extensively on all litigation issues and, in particular, those of interest to lenders such as defended repossession actions, shortfall recovery, duties of lenders, pursuing professional and Buy to Let mortgages.
