David Bailey   Litigation: Articles
The tribunal system was last reviewed over 40 years ago: is it time for a face lift?
For the first time since 1957, the Lord Chancellor has commissioned a review of tribunals in England and Wales. He has appointed a retired appeal court judge to head the review focusing on six key areas:
  • Disputes should be handled in a "fair, timely, proportionate and effective" manner;

  • The administrative and practical aspects of the decision-making process should meet the requirements of the European Convention on Human Rights for independence and impartiality;

  • The public's knowledge and understanding of its rights and responsibilities in relation to tribunals should be improved;

  • Funding and management of tribunals should be efficient, effective and economical;

  • The tribunal system should form a coherent structure for the delivery of administrative justice.
