Our Expertise
We act for a range of
high profile private sector property companies as well as contractors,
sub-contractors and developers. We also act for a number of consultants
in different fields in respect of the negotiation and finalisation of
their appointments in respect of complicated projects. The team is
familiar with the industry standard forms of contract including JCT,
ICE, RIBA, RICS and ACE forms to name a few.
In relation to disputes
work, we appreciate that disputes of any nature are often an unwelcome
distraction and a drain of resources and therefore we seek to resolve
disputes in a cost effective and commercially sensitive way so as to
assist clients in achieving the outcome they wish for. However, if
matters cannot be resolved by such an approach then the team has the
capability to take incisive action. Whilst the construction team
complements SGH’s litigation dispute resolution team in this area, the
construction team has specific specialist understanding of adjudication
pursuant to the Housing Grants, Construction & Regeneration Act 1996
which is the most common form of dispute resolution in the context of
construction disputes. With specific regard to adjudication, whether
under the Scheme for Construction Contracts or some other set of rules (TECSA,
TECBAR, JCT etc) the team has acted for a wide variety of clients
including developers, contractors and sub-contractors. Such experience
includes the enforcement and resistance of enforcement of adjudicators’
decisions in the Technology and Construction Court.
